Court of Protection - Deputy can make gifts out of protected person's surplus income and estate


The brother, and sole deputy, of a man who is now in an irreversible coma has obtained retrospective approval for the cash gifts he has made from his brother's GBP17-million estate to family members and political causes.

 The gifts made so far amount to only a few thousand pounds, but the England and Wales Court of Protection also granted permission for the deputy to make much more substantial gifts in future, both to his brother's relatives and to his favoured charitable causes (FL v MJL (2019 EWCOP 31).
