Attorney's unauthorised withdrawals to be deducted from his share of father's estate

The England and Wales Court of Protection has retrospectively approved GBP73,000 of GBP88,000 that the son of a 95-year-old man with dementia withdrew from his father's bank account under an enduring power of attorney, and which he said were gifts to him.

The unapproved portion of the withdrawals is to be deducted from the son's share of his father's residuary estate, or treated as a debt owed by the son if that share is insufficient to cover the amount.
